This translation is provided for your convenience. Only the German version is legally binding.
These terms of service are our general terms and conditions. They set out what Space Tattoo offers you as an artist, what you need to observe in return and how you can end the contract.
§ 1 Contracting party
Space Tattoo is operated by:

40215 Düsseldorf
Germany

§ 2 Scope
These terms apply to every contract on the use of Space Tattoo between us and you as an artist. Terms of your own only apply if we expressly agree to them.
Space Tattoo is offered exclusively to businesses within the meaning of § 14 of the German Civil Code (BGB), that is, to tattoo artists and studios using Space Tattoo for their commercial or self-employed professional activity. By registering, you confirm that you act as a business.
Anyone who visits an artist’s link or booking page or requests an appointment there does not enter into a contract with us. Their only contracting party is the artist.
§ 3 Conclusion of the contract and account
The contract is concluded when you register and accept these terms. There is no right to an account; for example, we may temporarily allow registration only through the waitlist.
The details you give when registering must be true and complete; if they change, update them in the settings. Keep your login details secret and do not pass your account on to others. If you notice that someone is using your account without permission, please let us know immediately.
§ 4 Services
With Space Tattoo you can in particular:
- create and design a public link page and a booking page with your own booking form,
- receive booking requests and manage appointments and clients,
- send your clients emails such as appointment confirmations and reminders,
- optionally connect your Google Calendar and use a custom domain.
We owe Space Tattoo in the form in which it is offered at any given time. We keep developing Space Tattoo and may change, add or remove features as far as this is reasonable for you. If an essential feature is removed, we will announce it by email at least four weeks in advance.
§ 5 Prices
Using Space Tattoo is currently free of charge.
If we introduce paid services, we will announce this by email at least six weeks in advance. You only incur costs once you expressly accept an offer. If you do not accept, you can keep using Space Tattoo as before for as long as we offer it free of charge, or terminate the contract at any time.
§ 6 Availability
We strive to provide Space Tattoo with as few interruptions as possible. We do not owe any particular level of availability. Temporary restrictions may arise from maintenance, security updates or disruptions beyond our control, for example on the internet or at our service providers. Where possible, we schedule planned maintenance at times of low usage.
Please also keep your own copy of data that is important for your business, such as upcoming appointments.
§ 7 Your obligations
Your link and booking page is your own presence, and you are responsible for it. In particular, you undertake:
- to provide your own imprint and your own privacy policy on your pages where required by law, for example as a link on your link page. Our imprint and privacy policy do not apply to your pages;
- to only publish content you are allowed to use and that does not infringe third-party rights, such as copyright, trademark or personality rights. This applies in particular to photos of tattoos and of clients;
- not to publish any unlawful, criminal, harmful to minors, discriminatory or misleading content;
- to process your clients’ data lawfully and obtain any necessary consent, especially if your booking form asks for health data;
- to use the email features only for messages to your clients about their appointments and not to send advertising or spam;
- not to misuse Space Tattoo, in particular not to circumvent security mechanisms, upload malware or burden the platform with automated mass requests.
If you culpably breach these obligations, you indemnify us against any third-party claims arising from it, including reasonable costs of legal defence.
If we become aware of unlawful content, we may remove it or block your public pages. We take your legitimate interests into account and inform you in advance where reasonable.
§ 8 Your content
Your content, such as texts, images and links, remains yours. You only grant us the simple, free rights we need to operate Space Tattoo for you: to store it, adapt it technically (for example to resize images) and make it publicly available on your pages. These rights end with the contract.
We only use your content for advertising if you agree beforehand. All rights to the software and design of Space Tattoo remain with us.
§ 9 Data protection and data processing
You are the controller within the meaning of the GDPR for your clients’ personal data, such as booking requests, appointments, answers from the booking form and reference images. We process this data only on your behalf and according to your instructions.
A data processing agreement under Art. 28 GDPR applies in addition and forms part of this contract.
How we process your own data as an artist is explained in our privacy policy.
§ 10 Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.
In the case of a slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for this kind of contract. Essential contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely.
Otherwise, our liability is excluded. These limitations also apply to our vicarious agents.
§ 11 Term and termination
The contract runs for an indefinite period.
You can terminate it at any time without notice by deleting your account in the settings or by sending us an email. We can terminate the contract by email with four weeks’ notice.
Both parties’ right to terminate for good cause remains unaffected. Good cause exists for us in particular if you seriously, or repeatedly despite a warning, breach your obligations under § 7.
§ 12 Data export and deletion
Before the contract ends, you can request a copy of your data by email, that is, your clients, appointments, booking requests and uploaded images. We provide it in a common, machine-readable format. If we terminate, you have until the end of the notice period to do so.
When the contract ends, your public pages go offline and we delete your account with all associated data, including your clients’ data, unless statutory retention obligations prevent this. We cannot restore deleted data.
§ 13 Changes to these terms
We may change these terms if there is an objective reason, such as a change in the law or new features. We will inform you of changes by email in good time beforehand.
A new version only applies to you once you accept it, for example at your next login. If you do not accept it, the previous version continues to apply; we may then terminate the contract with the notice period set out in § 11.
§ 14 Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Düsseldorf.
The language of the contract is German. An email is sufficient for any declarations relating to this contract.
